Texas's off-highway vehicle program counts an off-highway motorcycle as an off-highway vehicle, along with any other motorized vehicle used for off-highway recreation on the public land the program covers. The definition draws no line by power source.

These sections set the general rule; they do not say whether a particular off-road electric dirt bike can be registered. Under Texas's general registration law, the owner of a motor vehicle that is used or to be used on a public highway must apply to register it for each registration year, and it is an offense to operate a motorcycle on a public highway during a registration period without a registration insignia showing it is registered for that period.

An off-highway vehicle decal is required to ride on public land where off-highway riding is legal, on land the department buys or leases, and on land developed with its grants. The fee is $8 or an amount the commission sets, whichever is more, and a decal runs for a yearly period starting September 1 unless the commission sets another date. Riding without one is a Class C Parks and Wildlife misdemeanor.

The state's off-highway vehicle helmet rule applies to off-highway vehicles as chapter 551A defines them, which are ATVs (three or more tires), recreational off-highway vehicles, sand rails and utility vehicles. That definition does not name two-wheeled motorcycles. For those vehicles, the rule requires a helmet meeting US DOT standards on public off-highway vehicle land, a beach or a highway.

A rider younger than 14 on an off-highway vehicle on public off-highway vehicle land must be accompanied by, and under the direct supervision of, a parent or guardian or an adult the parent or guardian has authorized.

An electric bicycle has fully operable pedals, an electric motor of fewer than 750 watts, and a top assisted speed of 28 mph or less. Makers and sellers must label each one with its class, top assisted speed and motor wattage, and anyone who changes its speed capability must replace that label.
